ALOESUN: Sun & Tan Tracker Terms of Use

1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the ALOESUN mobile application, Apple Watch companion app, and related services (collectively, the "App"), provided by ALOESUN LLC ("ALOESUN," "we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.
2. Eligibility
You must be at least 13 years old to use the App. If you are between 13 and 17 years old, you represent that you have your parent or legal guardian's permission to use the App and that they have reviewed these Terms. The App is not directed at children under 13, and we do not knowingly collect information from anyone under 13.
3. Description of Service
ALOESUN provides UV index tracking, personalized sun exposure and tanning session guidance, skin-type based recommendations, and related wellness tools. The App may use your device's location to provide live UV index data relevant to your area.
The App is a wellness and informational tool. It is not a medical device, does not provide medical advice, and has not been evaluated by the FDA or any other regulatory body for the diagnosis, treatment, cure, or prevention of any disease. See Section 8 (Health Disclaimer) below.
4. No Account
The App does not require an ALOESUN account, login, or password. Information you enter in the App (such as skin type and session history) stays on your device, as described in our Privacy Policy. You are responsible for use of the App on devices where it is installed.
5. Subscriptions and Payment
5.1 Paid Plans. The App offers premium ("Pro") features through Apple's App Store in-app purchase system, managed via our subscription infrastructure provider (RevenueCat). Paid plans may include:
- An auto-renewing monthly subscription (
aloesun_pro_monthly), which may include a free trial - A one-time lifetime purchase (
aloesun_pro_lifetime) that is not a subscription and does not auto-renew
5.2 Pro Access. The App uses a hard paywall. Pro is required to start a session, view history, view Vitamin D detail, and start a session from Apple Watch. There is no free outdoor session. You can purchase Pro through a monthly subscription or a lifetime purchase, including any free trial Apple shows at checkout.
5.3 Billing. Payment is charged to your Apple ID account at confirmation of purchase. Auto-renewing subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current price. Lifetime purchases are charged once and do not renew.
5.4 Managing Subscriptions. You can manage or cancel an auto-renewing subscription anytime through your Apple ID account settings (Settings → Apple ID → Subscriptions). Deleting the App does not cancel your subscription. Lifetime purchases are managed through your Apple ID purchase history, not as a subscription.
5.5 Refunds. All purchases are subject to Apple's refund policies. ALOESUN does not directly process refunds for App Store purchases; refund requests must go through Apple.
5.6 Free Trials. If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
6. User Conduct
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse-engineer, decompile, or disassemble the App
- Interfere with or disrupt the App or the third-party services it uses
- Use automated means to access the App without our permission
- Misrepresent your skin type or other health-adjacent information in a manner intended to circumvent safety guidance
7. Intellectual Property
The App, including all content, features, trademarks, and functionality, is owned by ALOESUN LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
8. Health Disclaimer
PLEASE READ THIS SECTION CAREFULLY.
8.1 The App provides UV index information and general sun exposure guidance based on user-provided inputs (such as self-reported skin type). This information is general in nature and is not a substitute for professional medical advice, diagnosis, or treatment from a licensed physician or dermatologist.
8.2 Exposure to UV radiation, whether from natural sunlight or artificial tanning devices, carries inherent risks, including but not limited to sunburn, premature skin aging, and increased risk of skin cancer. You acknowledge and assume all risks associated with sun exposure and tanning activities, regardless of any guidance provided through the App.
8.3 The App does not account for all individual health factors, medications, or conditions that may affect your sensitivity to UV exposure. Always consult a qualified healthcare provider regarding your individual sun exposure risk.
8.4 ALOESUN makes no representations or warranties regarding the accuracy of UV index data, which may be sourced from third-party weather and environmental data providers and can vary from real-time, on-the-ground conditions.
8.5 You are solely responsible for your own sun exposure decisions. ALOESUN is not liable for any injury, illness, or damage resulting from your use of, or reliance on, information provided by the App.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALOESUN LLC AND ITS OFFICERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, HEALTH-RELATED DAMAGES, OR PERSONAL INJURY ARISING FROM YOUR USE OF THE APP. IN NO EVENT SHALL ALOESUN'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO ALOESUN IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify and hold harmless ALOESUN LLC from any claims, damages, liabilities, and expenses arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.
12. Third-Party Services
The App integrates with third-party services, including Apple's App Store, RevenueCat (subscription management), and weather/UV data providers. Your use of those services is subject to their respective terms.
13. Termination
We may suspend or terminate your access to the App at any time, with or without cause, including for violation of these Terms. You may stop using the App and remove it from your devices at any time. There is no ALOESUN account to delete.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising from these Terms or the App shall be resolved through binding arbitration on an individual basis, except where prohibited by law, and you waive any right to participate in a class action.
15. Changes to These Terms
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms. Material changes will be notified through the App.
16. Export Compliance
You agree to comply with all applicable export and re-export control laws and regulations in your use of the App.
